Canary Marketing Ends Lawsuit Against Twitter
The distributor filed to dismiss the case, which rested on allegations of six figures’ worth of unpaid bills for branded merch.
Canary Marketing’s (asi/156455) lawsuit against Twitter over nearly $400,000 in alleged unpaid bills for branded merchandise is over.
The promotional products distributorship, with locations in California and Oregon, filed to dismiss the case it had brought against the social media giant in the Superior Court of California, County of San Francisco.
A court official confirmed to ASI Media that the case had been dismissed. Canary Marketing, the firm’s attorney, and an attorney for Twitter did not respond to requests for comment regarding what, if any, resolution was reached.
In a March court filing, Twitter attorney Jon Hawk said his client and Canary were close to resolving the matter, adding the outcome from that would likely lead to Canary filing to dismiss its complaint.
In the suit, Canary Marketing alleged that Twitter had failed to pay $392,239 in invoices owed for branded merchandise. Along with other suits against Twitter, the case received national attention, drawing coverage from major mainstream media outlets.
In court documents, Canary Marketing detailed that it provided Twitter with more than $10 million worth of merch between 2013 and August 2022. There was never a problem with payment during that period.
However, from September 2022 on, Twitter stopped paying its bills, Canary Marketing asserted in the suit. Merch Canary sold to Twitter during the post-September period included a “swag gift box” for Elon Musk, the business magnate who bought Twitter last October. Products in the package included a $689 bottle of Nikka Whisky with a one-location sandblasted logo.
Canary Marketing’s website indicates that it has offices in San Francisco, San Ramon, CA, and Portland, OR. Netflix, Google, Sephora, Fitbit, Kentucky Fried Chicken and Slack have been among the distributor’s clients.
